1. Acceptance of Terms

By accessing or using the Video Message website (www.video-guestbook.com) and services, you agree to be bound by these Terms of Service. Video Message is a product operated by DEME Studios, a French simplified joint-stock company (SASU). If you do not agree to these terms, do not use the service.

2. Description of Service

Video Message provides a physical guest book kit with QR codes that allow guests at an event — such as a wedding, birthday, bar/bat mitzvah, baby shower, retirement, or celebration of life — to record short video messages. These messages are stored securely and can be compiled into an edited film for the event organizer. The service includes a web platform for managing videos and downloading the final film.

3. User Accounts

To access certain features, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Purchases & Payment

Products may be purchased directly on our website (processed by our payment provider, Stripe) or through third-party marketplaces such as Amazon. Prices are shown at checkout. When you buy directly from us, you authorize us and our payment provider to charge your selected payment method for the total amount, including any applicable taxes.

5. Content Ownership & Guest Consent

As the event organizer, you retain ownership of the video content recorded by your guests. You grant us a limited license to store, process, and edit this content solely to provide the service. You are responsible for obtaining all necessary consents from your guests to be recorded and to have their video shared with you and included in your film, in accordance with applicable laws. We will not use your content for any other purpose without your explicit consent.

6. Children & Minors

Our service is not directed to children under 13, and guests are asked to confirm they are at least 13 before recording. We do not knowingly collect personal information from children under 13. If your event includes guests under 13, you, as the organizer, are responsible for obtaining verifiable parental or guardian consent before they record a video. If you believe a child under 13 has provided personal information without such consent, contact us and we will delete it.

7. Acceptable Use

You agree not to upload content that is illegal, harmful, infringing, or violates the rights of others; attempt unauthorized access to our systems or other users' accounts; use the service for purposes other than its intended use as a video guest book; or reverse engineer, modify, or redistribute our software.

8. Intellectual Property & DMCA

The website, software, brand, and design are owned by DEME Studios and protected by intellectual property laws. If you believe content on our service infringes your copyright, send a notice through our contact page including: identification of the work, the location of the material, your contact information, a statement of good-faith belief, and a statement (under penalty of perjury) that you are authorized to act. We will remove infringing content in accordance with the U.S. Digital Millennium Copyright Act (DMCA).

9. Video Storage & Availability

Guest videos and generated films are stored for a limited period after your event, as indicated in your dashboard. It is your responsibility to download your content before the expiration date. We are not liable for content that is not downloaded within the specified timeframe.

10. Refunds & Returns

Physical products purchased through Amazon are subject to Amazon's return policy. For physical kits purchased directly on our website, you may request a refund within 30 days of purchase if the kit is unused and in resalable condition. For digital access codes purchased on our website, you may request a refund within 14 days of purchase provided the code is unused — meaning its event has not been activated and no video has been recorded against it. Because the digital film is a personalized service created from your guests' content, once a code has been activated or a film has been generated and delivered, the associated fees are non-refundable, except where required by law or in case of a defect attributable to us. For any issue, contact us and we will work to find a fair resolution.

11. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that content will be preserved without loss.

12. Limitation of Liability

To the maximum extent permitted by law, DEME Studios shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, arising from your use of the service. Our total liability for any claim shall not exceed the amount you paid for the product or service giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless DEME Studios from any claims, damages, or expenses arising from your use of the service, your content, your violation of these terms, or your failure to obtain required consents from your guests.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of France. Any dispute relating to these Terms or the service shall be subject to the exclusive jurisdiction of the competent courts of Paris, France, except where mandatory consumer-protection laws of your place of residence provide otherwise.

15. Changes to Terms

We reserve the right to update these terms at any time. Changes will be posted on this page with an updated date. Continued use of the service after changes constitutes acceptance of the new terms.
